Madagascar : Tempête judiciaire autour de quatre juges de la Haute Cour constitutionnelle
The Malagasy judicial system is once again in turmoil. The Antananarivo prosecutor's office has officially requested authorization to prosecute four of the nine judges of the High Constitutional Court (HCC). The stated reason: a serious accusation of "conspiracy to destabilize the country."
This legal offensive is taking place in an already tense political context, marked by strong tensions between institutions.
The most striking element of this case remains its timing. The prosecutor's request for prosecution comes just two days after a major decision by the High Constitutional Court . The Court had just rejected, as inadmissible, the request to impeach a close associate of the government: Colonel Michaël Randrianirina, targeted by a member of parliament for multiple violations of the Constitution.

Note: This episode comes on top of another recent incident. A few days earlier, the National Assembly had attempted to replace two of the judges in question, even though no position was legally vacant.
For these criminal proceedings to proceed, the public prosecutor's office had to formally notify the Minister of Justice. Given that the individuals in question are members of the country's highest constitutional body—the guarantor of the laws and arbiter of major institutional disputes—the procedure is strictly governed by specific rules that the judiciary must scrupulously respect.
